CITY OF MARNE HOUSING COVENANT FOR NEW CONSTRUCTION |
|
1. No lot shall be used except for residential purposes. No building shall be erected, altered, placed or permitted to remain on any lot other than one single or duplex dwelling not to exceed 2 stories in height .Any garage on the property shall be for not less than one or more than three automobiles 2. Minimum house size shall be 1200 square feet , include at least a partial basement which is not counted in the total square footage & must be completed within 18 months of contractual signing. 3. Unless otherwise specified, a 5 foot easement shall be reserved along all lot lines not fronting a platted street. This easement shall be for the installation & maintenance of drainage facilities and utilities, including telephone, gas, water, electric & cable service. 4. All site drainage shall be maintained as originally provided. Drainage ways shall not be altered, diverted or obstructed in any way that is detrimental. 5. No noxious or offensive activities shall be carried on upon any lot, nor shall anything be done which may be or may become an annoyance or nuisance to the neighborhood. All weeds shall be kept down to a maximum height of eight (8) inches above ground level. All plots shall be kept free from trash and debris. 6. No trailer, basement, tent, shack, garage, barn, outbuilding or structure of a temporary character shall be used on any lot at any time as a residence. The construction of any structure shall be subject to the ordinances & regulations set forth by the City of Marne and where appropriate permits shall be secured. The free lot program excludes mobile / manufactured homes—must be stick frame or modular to qualify. 7. No residential lot shall be divided into building lots having less than 7,000 square feet nor shall any building be erected on a residential building lot less than 7,000 square feet. No building shall be located on any lot nearer than 6 feet to any property line. 8. No building shall be erected on any lot unless the design and location of said building is in harmony with the existing structures and location in the land tract. 9. Each residence shall have a hard surface driveway. Each property owner shall be required to conform with the City ordinance for the construction of sidewalks. 10. No animals, livestock or poultry of any kind shall be raised, bred, or kept on any lot except for dogs, cats or other household pets provided they are not bred or maintained for any commercial purpose. 11. Grading of lots in preparation for construction shall be kept to a minimum and the natural contour of the land shall be preserved wherever feasible. 12. Lots shall not be used solely for the storage of RV’s, trailers, recreational equipment, boats, farm equipment or unused vehicles. 13. Invalidation of these standards by judgment or court order shall in no way affect any of the other provisions which shall remain in full force and effect. 14. The undersigned reserves the right to modify or waive these standards for any lot in case of an unusual circumstance or to prevent hardship.
